ALL FIREARMS MUST BE SHIPPED TO A VALID FEDERAL FIREARMS DEALER (FFL)

ALL NFA WEAPONS MUST BE SHIPPED TO A VALID FFL WITH A CURRENT SPECIAL OCCUPANCY TAX STAMP (CLASS 3 WEAPONS)

FosTecH complies with all federal, state, and local laws that restrict the sale and transfer of firearms, magazine feeding devices, and  other prohibited products.  The following is a list of restrictions that will include, in some cases policies set forth by FosTecH.

It is YOUR responsiblity to know your local and state laws ehich may prohibit or restrict your ability to purchase certain products that FosTecH offers for sale.

RESTRICTIONS:

ECHO TRIGGERS:

With the ever-changing wave of state and local firearms laws and regulations, individual federal firearms licensees are typically in the best position to know what firearms and accessories can and cannot be sold in their particular locations and, if they can be sold, how and to whom. Depending upon your location, an FFL may not be permitted to carry for sale all FosTecH products, and FosTecH has restricted its direct sales to preclude sales to individuals in certain states. For example, states such as New Jersey and North Dakota have defined “machinegun” under state law in a way that is more stringent than federal law and, as a result, a Echo Trigger system could be deemed to be a machinegun in such states. Other states have enacted other types of laws that do or may bear on the legality of some products. As such, FosTecH may, from time to time, restrict the sale of its products in various locations.

FosTecH will not be able to ship Echo Triggers to:  New Jersey, North Dakota, Oregon, or Washington

If you have a deposit on an Echo Trigger and reside in one of the listed states, please call our office for a refund or to make other arrangments.  812-445-4028

State and municipal laws and regulations, however, are subject to change at any time without notice to FosTecH. For this and other reasons, FosTecH cannot be relied upon to provide legal advice, and nothing in this message should be relied upon as legal advice. Legal questions and requests for legal advice should be directed to a qualified attorney in your area.

We thank you for your support of FosTecH and the American firearms industry, and we look forward to working with you for many years to come.

SBV SHOTGUNS;    FosTecH will not ship SBV Origin Shotguns to the following states

California: Penal Code 12020 (c)(1) defines SBS to include any firearm with a barrel length less than 18 inches and designed to fire a shotgun shell. Thus, under California’s definition (they do not require an SBS to actually be a shotgun) even many derringers in the state fall under this definition.

Connecticut: Connecticut defines “pistol” as “any firearm having a barrel less than twelve inches.” (53a-3(19)) Connecticut has an “assault weapon” statute (53a-202) defining “assault weapon” to include a pistol with two of the following characteristics: (i) An ammunition magazine that attaches to the pistol outside of the pistol grip; (ii) A threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip or silencer; (iii) A shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the non-trigger hand without being burned; (iv) A manufactured weight of fifty ounces or more when the pistol is unloaded. Under this definition, the Origin SBV would be deemed a pistol and an assault weapon under Connecticut law.

Hawaii: Hawaii defines a “pistol” to include “any firearm of any shape with a barrel less than sixteen inches in length and capable of discharging loaded ammunition” and has an “assault pistol” statute covering semi-automatic pistols that include two features from a list. Here, the Origin SBV has (1) an ammunition magazine which attaches to the pistol outside of the pistol grip and (2) A threaded barrel capable of accepting a barrel extender, flash suppressor, forward hand grip, or silencer.

Maryland: Maryland broadly defines “handgun” as a firearm with a barrel less than 16 inches in length. To be sold legally in Maryland, a handgun must be approved for the state’s handgun roster. The Origin SBV would be deemed a handgun under Maryland’s broad definition.

Massachusetts: Massachusetts defines “large capacity weapon” as any “firearm” (broadly defined) capable of receiving a “large capacity feeding device” – which includes any drum or magazine capable of holding more than five shotgun shells. Thus, the Origin SBV would qualify as a large capacity weapon and need to be included (by petition) onto the Massachusetts LCW roster. Even if firearm were approved for the roster, there is a question as to whether it would fall under the Massachusetts “assault weapon” statute as it covers “pistols,” but pistol is not defined.

New York: New York’s “assault weapon” statute bans pistols that meet certain criteria (e.g., folding stock, second handgrip, threaded barrel, mag attaches outside of the pistol grip, etc.) Unfortunately, nowhere in New York law is “pistol” defined. Given New York’s anti-gun bent, we would advise against testing the waters in this forum.

New Jersey: Same as New York.

Oklahoma: Oklahoma defines "Sawed-off shotgun" to mean “any firearm capable of discharging a series of projectiles of any material which may reasonably be expected to be able to cause lethal injury, with a barrel or barrels less than eighteen (18) inches in length, and using either gunpowder, gas, or any means of rocket propulsion.” (1289.18(A)). Under this definition, the Origin SBV and other guns that are not shotguns but that shoot shot shells and have barrels less than eighteen inches are included within the category of sawed-off shotgun.
